this is an out of box pen.......1 of the 3 batteries was dead..........it says on the side that batteries are not replaceable.......but i did replace the 1 bad battery.....the ones in there now are not full 1.5 volts each.........but enough to see that the pen does work........the top can be removed and the light switch button depressed and you can pull out the light and the battery compartment.........it is in really good condition with hardly any signs of use...shows a date of 10/19 on the pen........likely mfg date..........
